According Report, the Lawyers to Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), have filed an application to the federal high court, to hear the motion for Kanu to be transferred to the National Hospital Abuja for urgent medical attention
The application was filled by Kanu Agabi who is the lead counsel to the IPOB leader, but the matter came up this Thursday before Justice Musa Liman who is one of the two vacation judges that attends to cases as judges of the federal high court are still on their annual vacation.
Uchenna Njoku (SAN) who spoke on behalf of Nnamdi Kanu told the court that they filed all the medical records including a 14-page affidavit by Emmanuel Kanu, younger brother of the defendant.
Justice Liman said he would have preferred if the applicants can take the matter before the substantive judge that is in charge of the main matter. According to Justice Liman;
“The vacation for judges will be over. by next week Wednesday, courts will resume fully, why not carry this matter and go to the substantive judge,”? .
Njoku responded and told him that it’s because the matter is very urgent and also because Nnamdi Kanu is not asking the court to release completely or even grant him bail, he just asking DSS to transfer him to a proper hospital to receive better treatment and for a specialist to monitor his health very closely.
After listening to the applicants, Justice Liman said he is disposed to grant the application because of the urgency of the matter.
“I believe the right to health is as important as the right to life, and so I agree that this matter can be heard by this vacation court,”
He fixed Monday, 16 September 2025, to hear the motion, and also asked the applicant counsel to serve all the court processes to the respondents so they can also be available and present in court on that day.
