ADC Challenges INEC Over Court Order
The African Democratic Congress has criticised the Independent National Electoral Commission over its reading of a Court of Appeal directive, saying it was wrongly applied.
The party said the order to maintain the status quo does not stop its internal activities. It accused the electoral body of going beyond its powers.
The dispute followed INEC’s decision to remove the names of key party leaders from its records based on the court ruling.
The commission said it acted to preserve the situation until the case is decided. However, the party insisted no court has stopped it from holding congresses or its convention.
The preservation order, by its nature, is intended to prevent actions that would irreversibly alter the subject matter of litigation, not to paralyse the internal functioning of a political party.
That determination lies strictly within the jurisdiction of the courts, not the commission.”
The party maintained that its activities remain lawful and protected under the constitution. It said internal disputes should not stop democratic processes within the party.
ADC added that it would continue its programmes while urging INEC to stay within its legal role.
