The Supreme Court has thrown out the lawsuit filed by Adamawa State and ten other states governed by the Peoples Democratic Party, which challenged the declaration of a state of emergency in Rivers State by President Bola Tinubu.
The suit questioned the legality of the emergency rule under which elected officials in Rivers State were suspended for six months.
In a split verdict of six justices to one delivered on Monday, the apex court ruled that the eleven PDP-controlled states failed to establish a valid cause of action capable of invoking the Supreme Court’s original jurisdiction.
Delivering the lead majority judgment, Justice Mohammed Idris held that the plaintiffs did not demonstrate the existence of any justiciable dispute between themselves and the Federation that would warrant the court’s intervention under its original jurisdiction.
Justice Idris subsequently struck out the suit, ruling that the court lacked jurisdiction to entertain the matter.
